    Following efforts at the federal level and in California, New York has amended its fair pay law to strengthen the protections against gender discrimination in pay. Effective January 2016, the new law provides for increased damages for employers in violation of the law and limits the defenses available to counter claims of pay discrimination. Moreover, in a recent development with sweeping implications for employers with 100 or more employees, the EEOC has now proposed requiring those employers to annually provide detailed compensation information for all employees on EEO-1 reports beginning in September 2017. The EEOC will use this data to determine what companies to investigate for pay discrimination

    Practically speaking, pay discrimination has become much more “comp”licated. In this session, we will discuss:
    • New York’s robust Fair Pay Act and how it differs from the Federal Equal Pay Act;
    • The EEOC’s proposed EEO-1 Pay Reporting requirements and how the data will be both published and used for enforcement;
    • How to run privileged EEO pay analyses to identify and eradicate pay issues proactively.
