The presentation will review recent developments in immigration law including President Obama’s executive action on immigration which will allow up to five million currently undocumented individuals to live and work in the U.S. legally. The presentation will address what employers should be doing to begin preparing for these changes, including how to handle inquiries from employees who may be affected by the President’s initiatives. The presenter will also discuss I-9 compliance and best practices. ICE has deployed a variety of tools to uncover noncompliance, including informants, undercover agents, and I-9 audits. While employers need to be concerned about the full range of ICE’s investigative tactics, I-9 Employment Eligibility Verification form audits will in most cases be the approach used to review not only I-9 records, but also the employer’s hiring policies and procedures, staff training, and payroll records. As ICE continues its aggressive enforcement campaign against employers for potential violations of employee verification requirements, this workshop will focus on best practices in managing a successful immigration compliance program.
